A Florida quitclaim deed (also called a "quit claim deed") is a legal instrument that transfers whatever ownership interest the grantor holds in real property to the grantee — without any warranty or guarantee that the title is clear, free of liens, or that the grantor even holds valid title at all. It is Florida's standard tool for non-sale transfers between parties who already know and trust each other: spouses, family members, business partners, and trust administrators.
JK Closing Attorneys charges a flat $350 for a Florida quitclaim deed. This includes attorney preparation, attorney review of your situation, the simple county recording fee, electronic filing, and electronic delivery of your recorded deed. Documentary stamp taxes — which apply when there is a mortgage or consideration amount — are separate and will be disclosed before you owe anything additional.
Only the Grantor (the person or entity transferring the property) must sign. The Grantee does not need to sign. However, Florida law requires the grantor's signature to be made in the presence of two adult witnesses who also sign the deed, and the signature must be acknowledged before a Florida notary public. We offer Remote Online Notarization so you can complete this from anywhere.
Florida's documentary stamp tax applies to deeds based on the consideration amount stated. For most intra-family transfers with no money changing hands and no mortgage, the consideration is nominal ($10) and the doc stamp is minimal. However, if your property has an active mortgage, the outstanding mortgage balance may be treated as consideration — triggering doc stamps at $0.70 per $100 of the mortgage balance (or a different rate in Miami-Dade). We calculate this for you as part of our review before you sign anything.
It depends on the nature of the transfer. Florida's homestead exemption and Save Our Homes Cap can be affected by certain ownership changes. Transfers that generally preserve both include: adding a spouse, transferring to your revocable living trust, correcting a prior deed error, or retaining a life estate (Lady Bird deed). Transfers that can result in loss of homestead benefits include: removing one of two non-spouse joint owners, or adding an unrelated third party. Our attorneys evaluate this for every order.
